CHARGE: Driving a motor vehicle on the public road without due care and. Attention c/s 47 (j) (a) and 70 of the Traffic Ordinance as amended by Act 20 of 1969. JUDGMENT: EL-KINDY, AG, J. The appellant, Abdallah s/o Alfan, was charged with and convicted for driving motor vehicle on the road without due care and attention c/se 47 (1) (a) and 70 of the Traffic Ordinance Cap. 168. He was sentenced to.a fine of she, 500/- or four months imprisonment in default. He was ordered to pay shs. 300/- to the complainant for personal injuries and for damage to the bicycle. He is now appealing against his conviction and sentence On the 18th of January, 1970, at about 8 p.m., the appellant drove a saloon car, registration No. TDY 118 along Majita Road within Musoma township. While driving along the said road, he by passed the first cyclist (P.W.4), and then collided with the complainant cyclist (P.W.3) thereby the complainant fell down unconscious. He was taken to the • hospital where he was admitted from 1st of January, 1970 to the 7th of February, 1 970 when he was discharged. The medical evidence (Exhibit flAil) showed that the complainant suffered two out wounds of various sizes. These wounds were on the right temporal region, and they were about 0.5 c.m. deep. There was also a laceration wound of about 2.5 c,m, by 0.5 c.m. deep on the right chin. The complainant also suffered concussion on the part of the body. This particulars wound was described as dangerous harm, while the rest were mere harm. The doctor found that the cut wounds were caused 1 y sharpe object, while the laceration and the concussion was caused by blunt object. The road was described as a normal mu.ram road, but at the particular place there were heaps of sand (P.W.2S evidence and that of the appellant). The appellant's vehicle was inspected by Inspector Rashid (p.w. I) on the 19th of January, 1970. He found that the vehicle was in good condition before the collision but, after the collision, "The bonnet and left mudguard was damaged" (Exhibit "A" were damaged. A sketch plan (Exh. "B") was prepared by police consitable Anselm (p.w. 2) immediately after the collision. The sketch plan showed the vehicle made skid marks of about 33 feet. He said that the cyclist was on his side, and that wnen he approached him, the cyclist went to his sidei And that in an effort t o d00 him he went on his wrong side while the cyclist was still coming towards him. He said that he braked, and the cyclist came and bumped himself against his vehicle. He alleged that before the accident, the cyclist's lamp was not on, and that he went to the wrong side "as my correct side there were heaps of sand." Under cross examination he said that he was about 60 yards away when he saw the cyclist. Malenga (D,w.2), who was in the appellant's vehicle sitting at the back seat, said that he saw the cyclist infront of them in the middle of the road. That the cyclist went to his correct side and that when they dodged him, tha cyclist bumped himself on the vehicle.: He said that the cyclist appeared drunk, and his bicycle did not have its lights on. In cross examination, he said that he came to see the cyclist when he was about 10 paces away and that although he sat at the back seat he could see clearly infront of him. Msosa (D.W.3) said that he was sitting in the front seat with the appellant.. He said that they first met one cyclist, and then they saw another cyclist who was cycling without a lamp.. Further on he said- "He was on his wrong side of the road. I could see the bicycle not steady showing that the cyclist might be drunk. We approached him and then the driver went on the wrong side of the road in order to dodge the cyclist. The driver stopped there. Then the cyclist came and pumped against the vehicle. He fell down." Under cross examination, he testified to the fact that the lights of the motor vehicle were on, and that he could see clearly infront of him and that infact he saw the cyclist for the first time when they were 80 yards away, and testified to the fact that there were "heaps of sand" on the road 0 In coming to the conclusion that the driving of the appellant was without due care and attention, the learned Resident Magistrate said this: - "The facts which were undisputed are that the accused (Appellant) went to his wrong side in order to avoid the cyclist and that the accused saw the cyclist some sixty yards before the accident. I take the driving of accused not to be with due care and attention for the following reasons, . Since the accused saw the cyclist at a fairly good distance, he should have slowed down and even brake in time. .
