Questions and positions

Legal issues

Party arguments

Applicant
The appellant contended there was a fight in which he sustained a head injury and claimed he used a knife by mistake, thinking it was a stick, suggesting lack of malice aforethought and possible provocation or self-defence.
Respondent
The respondent argued that the medical and circumstantial evidence established malice aforethought, the wounds on the deceased were excessive, and the appellant's injuries were superficial and likely sustained after the incident, negating self-defence or provocation.

05

Court’s reasoning

  1. 01

    Penal Code, section 196

Malice aforethought is established by the nature and number of wounds inflicted and the circumstances of the killing.

  2. 02

Common law principles as applied in Tanzanian criminal jurisprudence

Self-defence or provocation must be supported by credible evidence of a genuine fight or threat to the accused.

06

Ratio, limits and disposition

Ratio decidendi

The appellant inflicted twenty-two cut wounds on the deceased, which established malice aforethought. The appellant's claim of self-defence or provocation was not credible given the superficial nature of his own injuries and the overwhelming evidence against him. The conviction for murder was proper.

Obiter and limits

  • A seven-day-old wound cannot be described as fresh; the appellant likely sustained his injuries after the incident while resisting arrest.
  • It is not credible that one could inflict twenty-two knife wounds thinking a knife was a stick.

Court disposition

Appeal dismissed

  • Conviction and sentence of death by hanging affirmed

The apollant contends that thro was a fi;ht in which he sustained a hoed injury. It is true 'that when he made his ex1ra—judicial statement on the 11th April, 1978, the justipo of the peace noticed a fresh wound on appellant 's head. The question arises whehor this wound was sustained by the appellant on the /:bh April, 1973 when the deceased died. To axe of the considered view on the..Qvidonce thc,c, the fresh would noted by%'1io justice of the peace ceFthQ 11i April, 1978, cou).d not have been sustained by the appellant seven ci:'js earlier on the 4th Apri1 1978. A soven—dayb old wound cannot he said to be fresh. The appellant must have .staned it some days after the doath of the doeas1. The evidence shows that there was every likelihood for the appellant to sustain such wound after he '1isap:.eared fr'm M sccne. to resisted arrest and was violent when arrested on the 7th April, 1978. It required a crowd of people to subdue his attenr:ts to ascae. Under those circumstances he must have boon injured on the head and such wound would still be fairly fresh four clays later when he met the justice of the peace on the 11th April, 1973. The Justice of the peace also notipad a soond Crong of superficial VJOUfl(is on his limbs and choock. It is net 'sux'pris1
