The East African Court of Justice has exclusive jurisdiction to interpret the EAC Treaty and invalidate Community Acts. National courts may entertain matters involving Treaty violations and apply the Treaty, but must refer questions of interpretation to the EACJ when necessary. Articles 6, 7, and 8 of the Treaty are justiciable before national courts; paragraphs 2, 3, and 4 of Article 123 are not justiciable until operationalised. Decisions of the EACJ take precedence over national court decisions on similar matters.
