RULING 23dAugust, 2023 On 27th July, 2023, Land Case No. 294 of 2022 was called for final pretrial conference. The applicants who were the defendants in the main suit did not appear without notice. The court opted to strike out the Written Statement of Defence and directed the matter to proceed exparte on 29th August, 2023. The applicants (defendants in the main suit) were aggrieved by the order hence this application for the following orders: "a) That, this Honourable Court may be pleased to set aside the ex-parte order made on 27th July 2023 in Land Case of 2022 and restore a joint Written Statement of Defence of the Applicants. b) Costs to follow the events; and c) Any other reliefs as this Honourable Court may deem fit andjust to grant." The Application was supported by the affidavit sworn by one Edwin Joshua Webiro, State Attorney. The Respondents could not file counter affidavits to challenge the application. The matter was called for necessary orders on 23rd August 2023. Mr. 3 Uiso Luoga, learned State Attorney appeared for the applicants while Mr. Benito Mandele, learned advocate represented the respondents. On the particular date Mr. Mandele submitted on behalf of the respondents to have no intention of countering the application. He conceded to it requesting the court to grant the same. I have also taken time to go through the affidavit deponed by one Edwin Joshua

Webiro, State Attorney who works for the office of the Solicitor General. According to the affidavit, the reasons of absence on the fateful date are such that he was appearing for hearing in Miscellaneous Civil Cause No. 5 of 2023, before Honorable Ndunguru, J, Ismail, J and Kagomba, J. in the High Court of Tanzania Mbeya sub-registry. He also averred that Peter Sengerema, a State Attorney who is also in conduct of the matter was indisposed on that day result of which he failed to appear in court and attend the pre-trial conference. I have considered the cause demonstrated herein above and in view of the submission made by Mr. Mandele, learned counsel for the respondents, I am of the firm view that, it is for the interests of justice that the application should be granted. In the upshot, application is granted without costs to the effect that the Written Statement of Defence of the 4 Applicants in Land Case No. 294 of 2022 is restored. Exparte hearing order is vacated.
