Land Case / Judgment After Full Trial

  1. 1 Who is the lawful owner of Plot No.68 Hananasif?
  2. 2 Whether Plots 411, 412, 413, 414, and 626 Block 40 were created out of Plot No.68 Hananasif and if their creation was lawful
  3. 3 Whether the Plaintiff is justified to block the way of access used by the 4th and 5th defendants

Ratio Decidendi

The Plaintiff, as administratrix, is the registered owner of Plot No.68 Hananasif, evidenced by a valid certificate of title. Plots 411, 412, 413, 414, and 626 Block 40 were created out of Plot No.68 Hananasif based on a later survey plan (1998) that overlapped the earlier plan (1978) without proper amendment, rendering the later plan invalid to the extent of the overlap. The 1st and 2nd defendants, as public authorities responsible for land allocation and survey, failed to produce the necessary survey plan and are the source of the dispute. The counterclaim regarding blocked access was not proven by the 4th and 5th defendants.

Court Disposition

Plaintiff's claim allowed; counterclaim dismissed.
