Ratio Decidendi

The Court held that Burkina Faso is liable to make full reparation for the moral and material prejudice suffered by the close relatives (spouses, children, fathers, and mothers) of the deceased, as well as a symbolic sum to the Burkinabè Movement on Human and Peoples’ Rights, due to its failure to act with due diligence in investigating, prosecuting, and trying those responsible for the murders, in violation of Article 7 of the African Charter.
