The High Court (CHIPTA 9 J.) sentenced him to death. He appealed against both conviction and sentence arguing that as he killed the deceased in circumstances which amount to provocation the High Court should have convicted him of Manslauter only. The allegation that the appellant killed the deceased was not in dispute. Several witnesses including the appellant himself narrated how the deceased met his death. p.'l.2 Monica the y appollantts daughter was the cause of it all.
