He was arrested near the auction before tl' -tL cor reached other cattle. The witness was saying, in effect, that the apellant was driving that animal. The cc'mp'lainant was more to the point when he said he "saw the accused emerge with one head of cattle from the western side of the auction." The apellant put up the defence that he wdb not in poss.essionof that coaid that,he'had, gone there for a matter wholly unconnected with it., but considthing the p 1'Qsecution witnesses in the prevailing circumstances cOld not have been nistaken whether or not he was in possession of that.'cowad,,b,aving in mind the basic contradictions the appellant's evidence bears with, that of Dw.1 from which the only inference to draw isthat he and his witnesses were lying, I am satisfied he was rightly found to have been in posessioh of that cow. That was less than24 hours after the theft :.nd it follovis. he was rightly convicted of stealing it. Nr. C}ismbakre for the ap:)ellant has also made beavy weather of the fact thatthe learned resident magistrte after heaing.Pi.1 'and Pw.2 only, cancelled the appellant's bail beOause, as he observed, • there was already great probability that the prosecution woü1d'Ostablih a case, with theattendant.dangz that the apellamt might be tempted to cbseond if he continued to be out on bail. He urges, therefore, that the trial magistrate had been prejudiced against hi client long befoi th etrial ended I cannot, with respecL, read any prejudice in -the remarks made by the court as for, the rsason for cancelling bail. It was not in anywey prejudging any issues and it was then only preoccupied not rcth the gin,lt or innocence of the appellant but with ha possibility that in view of what he had already heardhe Liig}'tbe tempted to abscond. The magistrate inthy view was obliged to have such'- possibility in mind in considering whether to extend bail, while I cannot-fault the decision he then took on ii;.
