The Liagistrate's Courts Act, Cap.537 lays down the jurisdiction of primary courts. Under section 14 of this Act, a primary court has jurisdic- tion in proceedj.n:s (a) of a civil nature where the law applicable is % customary law or Islamic law including those for the rccovcry of civil debts, rent or interest due to the Republic, c-oven'uaent, etue's , It is obvious that as the Christian marriage is not governed by customary or Islamic law bwt by the genoral law, the primary court cannot entertain asuit invol- ving such arriage In any case, as stated above, the Llatrinonial Causes Act, Ca.p.364, which gOVernS Christian ilarriages, does not include a primary court as a court competent to offer relief in Christian marriages. There is yet no written law uhich cfers jurisdiction on thd priarny courts to try cases in which a. marriage under Cap.109 is in issue. Ror the above reasons, I an satIsfied th&t the primary court had no jurisdiction to entertain this suit Tiie district court :roperly direc- ted itself on the neotion of jurisdiction and this was one o: the reasons for reversing the decision of the primary court. In the result, his lasthopo may be to institute proedings for divorce or judicial separation Tho appeal is dianiibsed but I think in all the circumstances, there will he no order for costs.
