Although respon- dent stated before this Court that before he was asked to cult by Bi. iikuba he had been cultivatjn that land, it is not, however, established that he had aseumed full PCsPeSsion of the property In any case, the respondent appeai to have abandoned the property for over 30 years as from 1930--1963 There has been no explanation for such absence. It is not at all clear on uhat roi.u'ids the district court disturbed the decision of the primary court. If I understand correctly the brief juduent of the district maistrate, he preferred the evidence of tile respondent to those of the appellant, brom a perusal of the record 9 it cannot be said that there was no evidence to support the appellant's case. For is there any misdirection apparent in the jud5ment of the primary court • Quite apart from the wealseess of evidence to support respondent's claim to the disputed sharaba (for example no boundaries could be found) 9 yet it would be uite ine:uitable to dispossess the appellant of a shamba which has been cultivated, developed and occupied. for over 30 years when the respondent could be said to have abandoned it. Accordingly, both customary law and e:uity favour the appellantt s claim to be entitled to possession. and ownership of the shanha without interference from the respondent. This result is in keepin, with the gcnexal land policy of this country where emphasis is placed upon occupation and development The appeal is allowed with costs to be assessed by the (listrict court.
