To 6961 JO cet.0K eci ItU!TO) 0L61 JO 553i 0 ,bl 105dV VI O VIVI 40 tialloo HOIH UHL 91 - I - 2 - in his Petition of Appeal the appellant now asserts for the first time that he was not present at Rihesa as alleged by the witnesses for the prosecution, but that he was at home on that day; he further states that he had never seen the cattle until he was a.rrosted and taken to the Police station, where the beasts were being held. The trial magistrate had no opportunity of considering such defence of the accused, for he did not choose to give any explanation at the trial and I consider that the raising of an alibi at this stage of the case has no worth whatsoever. Even on appeal the accused does not refer to any person who could support his statement that he remained at his home at the time when the prosecution witnesses state he was arrested with the stolen beasts and there appears to be little value in these late assertions on his part. In the event, this Court consideøsthat the evidence before the trial Court leaves no doubt as to the guilt of the accused and that the appeal is without substance. Sentence is in conformity with the requirements of the Minimum sentences Act. After reading the record, this Court is satisfied that the appeal had been lodged without any sufficient ground of complaint, and I consequently order that it be forthwith summarily rejected.
