Althogh the assistant manager Sikh Saw i11 was ca11d as a wji;neen he 4aven. evidence himself on thic point. Therefore, the stntetherit by the police o ficor oould notbe heaz'nay, fior can it be naid that the timber came into the posSession of the appellant on account of hia emp oyer becauso the evidence ek.owC that the appellant took the timbez from Luiwa Saw ijLl an his own beliaIf and not on behalf of M/S Such Saw ill. Consequently 'the charge of stealing by Servant cannot be said to have been proved beyond reasonable doubt. There was, however, abundant evidence to support conviction for simple theft contrary to section 265 under which the care was partially laid, It is true that the timber was wron:ly described in the charge shoet as belonging to M/S Sikh Saw ill because the evidetoe shows that it belonged to Eulwa Saw Mill. But it eorns that this error would not vitiate the conviction because it baa not occasioned any failure of justice. In Posto Maaibo v. E. 1959 JVA, L.R. p. 257 the appellant was wrc'ngly convicted of stealing oroodile skins, the property of her Najety which oariie into his possession by virtue oi his op1oymcnt. The evidence, however, shd that the crocodile skins in fact were the property of a, local authority, the bunyoro Native 0ovorment1 The Righ Court of Uganda held that the error had occasioned no miscarriage of jutice, eince nothing turned on thti ownership of the crocodile skins. The appellant himself laid no clm to the ownerdhip of them. Accordingly the conviction tor stealing the property of Her Majesty was set aside and aubstitted thereto conviction for eteaiia' the property of a local authority. This decision appears to me'to be very permios*ve and one which may be followed because the circumstanced involved are aimilar, Accordinly the conviction in the present case of stealing by servant is set aside and one of simple theft substituted., The appellant was sentenced to 12 months imprisonment. But since he has now been founcl guilty ot only simple theft which is minor to the offence af stealing by servant of which he was originally convicted, it would seem that a term of nine months ipriso.nswnt would meet the Justice of the case. In view of the substituted conviction the ørdcror compensation made in favour of MS Sikh Saw 14111 cannot be sustained. Accordingly the order is zet aside and sub.tituied thereto an order that the appeUnrit payc She. 300/- as compensation to Bulwa Saw Mill.
