I think the conclusion reached by the learned r.iaristrate is irresistible in this caso If the appellant had not been the one who had broken the door of his house, he would not haro been so calm about it'. He would have s at least expressed his surprise, but he simply told the police that nit is usual. I cxi satisfied it was not usual to find his door in that scto, and there wore definitely, as for Chcha, visible riks on the door iowinc that the door had been interfered frcri outside. In his moorandun of appeal, as usual, the appellant challenged the findiis of fact made 1y the learned Lia[istrate. I an satified, as I have endeavoured to show, the evidence supported the findinr;s'. And the only reason vy the appellant would seek to zt act as ho did, is to remove the bottles from his house and - this be did, but the position from where they were found is so proximate so as to justify the findix tbt they cane from the house of the appellantS I a:ree, therefore, that the appeal aroinst conviction has no i:e1J -t, and is acccrdinr1y disnissed. He was sentenced to 12 months in prisox The ndm.in solLitenco for such offences is five years in prison. He was a first offender. The prosecutor had apparently asked for exemplary serrtence in view of prevclenc of such offcncesin the area, and the learned najçistrato seemed to have accc±ed tO this. Care should be taken thcn this factor is pleaded lest an accused, who is a first cfencler, is punished for the alledod misdeeds of others. I areo with the learned naistiate that the appellant did not pososs these bottles for business purposes He was also carnin a wcio in hi6 capacity as a watchman, and had children and ced mother to look after. TaIthi these points into consideration, I think the sentence imposed is too severe and should be rcduced As the appellant has already served for over five months, the sentence is accordin1y reduced so that it results in the immediate release of the appellant from prison.
