The second appellant also in a sworn statement gave an accoulTt which was substantially the some as that of the first appellant with the only addition that after reaching Ujiji he stopped there while the first appellant and the complainant proceeded to Kigona. The learned trial magistrate ± i evaluating the evidence rejected the story of the appellants as being aTtrue, and it would appear that he was entitled to do so According ;o the appellant a the complainant and his family asAtheir hOsts treated thou with a great degree of hospitality and bindness 0 This cord al relationship continued even after the appellants left the hone of the complainant because the complainant escorted the appellants, dsguests, to Ujiji. and Jefore taking his leave of then the firt ap ellant bought him a necl'T. Moreover, as reaards the first aiDpellant he was found in uossession of a larpe quantity of goods neily bought, some of which including the bed and matross were quite expensive and were bought on the very some day he left the complainants home' This sudden access to wealth which has not been explained by the appellant could lead to the only reasonabic inference that the • ppellant acquired such wealth by stealing from the complainant' a hcuseAgain as regards the second appellant., he was also found in possession of a number of new items altuhauCh not as many as those found in possession of the first appellant' 17hct is more? on his errest when the police asked him if he had been to 3ulombola the vilJge of the complainant, he at first denied but agreed only later on SuCh conduct could not be consi at ent with the innoeonc a of the appellant; If the visit to Bulombola had been innocent there seems no reason why he should be hesitant in saying that he did make this viait., Considering all the facts which wore before the court therefore, I am of the view that theie was sufficient evidence on r4iich the learned magistrate could have convicted the appellants as he did -'i The sentence of two years imprisonment with 24 strokes imposed on each appellant in resneet of the first count was the minimum nrescribed by lawq anti that of 12 months imposed on each appellant in respect of The second count was neither excessive nor did it affect the positioji since it was made to run concurrently with that on the first count'.
