P. does not remember the number of his engine which he lent to the appellant or thcnumbr of the engine which he received from the appellant in exchange. The apcllant however never returned to redeem his engine as promised. Thei the police acting on information arrested the appellant in Singida on .,3,70 while he was driving the motor vehicle BK 3590. The complainant (P.8) identified this vehicle as hic because he had fitted i - d -th el ctronizod button near the steering wheel, a opccial lining near the electronized boa: and new springs in the cushiono. He also identified the vehicle because ho had cut the shock absorbers at the rear. The appellant was therefore chrgcd with stealing the complainant's vecicle MZB 819. In his sworn statement the appellant in affect denied the allegation and claimed that the motor vehicle BK 3590 is his property. 40 The learned trial magistrate however rejected his claim and convicted him. He found that the motor vehicle BK 3590 found with the appellant did not belong to the appellant; it was the motor vehicle i'.IZB 819 which was stolen from the complainant (P.w.8). The appellant had altered the regIstration from IIZB 819 to BK 3590 and that this lrtttcr was a fake. It would appear that the identity of the motor vehicle alleged to bb stolen has not been established beyond any reasonable doubt. There is evidence from the complainant himself to show that the engine and chassis numbers on the motor vehicle BK 3590 did not correspond to those of HZB 819 which was stolen from him. Furthermore Kaka Singh (P..i) :tho alleged that he lent an old engine to the appellant said that he cannot remembar the number of that angina so lent. On the other hand the appellant in asserting his ownorsuii]p of motor 'vehicle BK 3590 produced the registration card (Exhibit 2) bearing the details of this vehicle but the learned trial magistrate disre(arded the said card because it was re—written in ink, it had no official stamp and there- fore it was suspect. This however could not be conclusive that the vehicle did not belong' to the appellant. In order to remove any reasonable doubt it was necessary to ohack with the motor vehicle central registry and to show that the appeilant was not the registered owner of BK 3590, It io noted that the appellant spocifically raised this poin during the trial but no steps were taken to check with the central registry. In the absence of any such evidence therefore it would be impossible to say any degree of certainty that the motor vehicle BK 3590 does not belong to the appellant but to the complainant. The learned magistrate also found that the engine in tho complainant's vchicic IZB 819 was exchanged for an old one and that this wa - 1 C) I. the onginc which Kka Singh (P..i) held a lion on until the appellant o paid for the i'cpeirs which were done to his motor vehicle. This finding however is open to doubts In the first piece ICaka Singh (.w.i) said ri that he does not know the date or month the appellant brought the engine to hinbcforc the complainant's motor vohicic LIZB 819 was stolen, in yj which case the said engine could not be relevant to the complainant's vehicle. Secondly Kaka Singh said that he does not remember the number of the engine which the appellant brought to him, and when the , said engine was c::erninod by the trial court the number on it was found to . have boon removed by filin60 Thus, there is no conclusive evidence tc C) c show that the enc.ine in question necessarily oloncd to MZB 819; it 1. is possible that the engine relates to some vqhiclo other than MZB 39. The learned Statc £ttorncy who appeared for the Republic did not sock to support the conviction and for the reasons as outlined above I am of the view that it would be unsafe to allow the conviction to stand. ccording1y the appeal is allow..d, 'tho conviction and sentence are set ado and tha appellant is to be released unless otherwise lawfully held in custody.
