This section is to the effect that - "Where more than one offence is charged in a charge or information, a description of the each offence so charged shall be set out in a separate paragraph of the charge or information called a count. In this case the learned magistrate proceeded with a charge of one count which embraced more than one offence; inspite of the mandatory provisions of the above section. As it is difficult to say that the appellant was not prejudioec by this irregularity the defect is not curable under section 346 of the Criminal Prooedure Code. Another reason why this appeal was admitted is that the magistrate may well have misdireoted himself as to the burden of proof in a criminal charge when he said "I do not agree with the accused" because the prosecution proved the case beyond all reasonable doubt". I agree the use of the statement - "I do not agree with the accused" is unfortunate as it may be interpreted to mean that the magistrate convicted the accused because he did not believe his story - But the learned magistrate immediately followed this statement by the words ---------"because the prosecution proved the oase beyond all MY reasonable doubt" - This, inview, is an indication that the magistrate was aware that onus of proof in a criminal case is on the prosecution. I am however of the opinion that failure to follow the provisions of Section 136 (2) of the Criminal Procedure Code amounted to an incurabl irregularity. The conviction which is not supported by the Republic is hereby quashed and the sentence is set aside. I have seriouly considered whether I should order a re-trial but in the circumstances of this case I do not think it is necessary to do so. The accused has almost served the whole term ãf imprisonment and, if I may add, it was due to the fault of the prosecution that the fatal irregularity came into being The accused is to be released forthwith unless he is in custody in connection with another charge.
