The two appellants Bumela Kuiwa and Kuiwa Lei wearg4d with and convicted of stealing by person employed in the public service contrary to sections 270 and 265 of the Penal Code, and were each sentenced to 2'years imprisonment with 24 strokes of corporal punishment. They have each appealed against both conviction and sentence and the appeals are nso1idated. The facts were that on 14.2,70 Nicholaüs Manyaka, a detective Constable (p.w.i) received an' information that one Magulata Isaac and one Titus Musa were leaving Shinyanga for Moshi and that they had on them some pieces of diamond. Acting on that information Nicholaus went to the Bus stop at about 7.30 p.m. where he found the two persons talking to both appellants who were special constables wearing police uniforms. Nicholaus ordered both appellants to search the two suspects while he remained around to keep'away the people who were drawing near to watch the search. After the search, both appellants reported to Nioholaus that they did not recover anything, whereupon Nioholaus decided to take the suspects to the Police station for a more thorough search. The appellants also went along to the Police station. On the way Nicholaus -, asked one of the suspects where were the diamonds which he was informed that they (the suspects) had in their possession, and the suspects told him that they had handed the diamonds to the appellants. Nicholaus therefore suspected the appellants and on arriving at the Police Station he decided to search them. He telephoned a superior officer, Corporal Sabas (p.w. 3) asking him to come to the police station. On his arrival there Nicholaus told him in the presence of the appellants that he wanted to search the appellants because he suspected them to be in possession of diamonds. He therefore asked Corporal Sabas to search him first and after this was done he (Nioholaus) proceeded to search the appellants. As he began to search the first appellant the later said that he had the diamonds and he produced a wrapped piece of paper which he gave to NicholauE. Nicholaus passed it to Corporal Sabas who opened and found it to contain 14 pieces of diamond. As he turned to search the second appellant this appellant said, "here they are" and he produced a wrapped piece of paper which he handed ±itr to Corporal Sabas who oprned and found it to contain 3 pieces of diamond. . . . . ./2. ••.• o.is.eqq.
