JO OLT JO 6L . °M 8 S U O ICUTWTJO 1uTxO 'oL6i dO L o& 'ivddv 'IVNINIUO (x&sIDru VZNVMN NOLLOItSIHflf &JVT1ddV VZNVMW JV VIMVZNVJ, JO JHflOO HDIH a lll kfl a tJsT 0 i; 2 l* TI —2-- This being the position, I can only say that the learned Magistrate who Baw. and heard the witnesses is in a very much better position to assess their truthfulness or integrity than this court which merely reads the record. f agree with the de'ence that. there may be cases where prosecution witn sses so obviously contradict themselves that an appellate court may find it necessary not to uphold a conviction - but this, with due respect to the learned counsel, is not one of those cases. In this case there was the testimony of the complainant, supported as it is, by the evidence of Police constable Silas (PW.3), that it was the appellant who assaulted him. The only evidence contradicting their testimony is that of Police constable Hermes (P.W.l); which evidence did not impress the learned magistrate as truthful. I fail to see why I should differ with the learned magistrate's conclusion, based as it is, on a finding of fact. I agree with the Republic that there is no merit in the appeal against conviction.. .ppeal against conviction is hereby dismissed. As the defence has withdrawn the argument regarding sentence on the ground that the appellant has since been released under the recent Presidential Amnesty Order, I do not propose to deal with the •.uestion of sentence in detail.1 I would however say that in the circumstances ,of this case. a sentence of 12 months imprisonment cannot, by any stretch, be said to be excessive.
