' CHARGE: Robbery with violence, Contrary to Se tion 285 and 286 of tLe Penal Code Cap, 16 Vol. I of the Laws 2 5JA71 JUDGMENT KISANGA, Ag.J. The appellant Mwita Kitabuka in this case was charged with and convicted of robbery with violence contrary to sections 285 and 286 of the Penal Code, and was sentenced to two years imprisonment with ) 24 strokes of corporal punishment. He now appeals against both conviction and sentence. It was alleged that on 2.9.69 the complainant Mahere Masango (p.w.i) went to sell his cow at Majimweru. He sold the beast for shs. 85/-- and during this transaction the appellant was present. After the sale the complainant set out to go home. On the way he found the appellant who had a sime (long knife) in his hand. The appellant ordered him to give him the money (apparently the money received from selling the cow) but the complainant refused. Then there followed a struggle during which the appellant out the complainant with the sime. The complainant raised an alarm which attracted Jurna Chacha and Magembe Mwita to the scene. As these two approached, the appellant ran away taking with him which acoatLhe snatched from the complainant and in which the complainant had put the shs. 85/-. received from selling his cow. When the appellant reached a bush some distance away he threw away the coat there and disappeared. Juma Chacha who tried to run after the appellant picked it up and brought it back to the complainant who checked it and found that the shs. 85/-. which he had put in it was missing. Then Juma Chacha and Magembe Mwita took the complainant to his home and on the folldwing day the complainant reported the matter to the Police at Musoma. The '" complainant was issued with a Police Form 3 to go to hospital where he was admitted for two weeks. The appellant was arrested .on 18.2.70 and charged with this offence. In his unsworn statement the appellant flatly denied the allegation and said that he knew nothing about the alleged incident.
