She further said the trial magistrate should have made an order for compensation for return of Shs.19,000/-. The learned State Attorney formally submitted that the appellant should be punished either for offences under the first three counts or Lunder for the offence Jhe fourth count but certainly not on all four of them. She submted that the appellant be sentenced correctly under the Minimum Sentences At 1963 for the offence under the fourth count and that sentences imposed under the first three counts be quashed and set aside. Going through the record it is abundantly c1ea that offences under all four counts arise out of the same transaction, and to charge and convict him on all four offenoes and to order that the sentencea shall run consecutively 'amounts to, punishing the appellant more than once for the same offence This indeed contravenes the provisions. of section 21'ofthe Penal Code, which reads: 'A person shall not be punished twice, either under the.' provisions 'of this Code or under the provisions of any, other law, for the eame offence." Thus it is clear that the sentences imposed by the trIal magistrate contravenes the provisions of section 21 of't'he Penal Code. He should be punished only once for what he did. The learned State Attorney submitted that the appellant be sentenced for the offence under the fourth count which is contrary to Minimum Sentences Act and the sentences imposed for offences under the first tbro counts be quashe,d and set. aside. To this I agree, Accordingly :1 order as follows* Sentences imposed for the offence's under the first, second and third eount are quashed and set aside. For the offence under the fourth count the appellant is to be imprisoned for two years. (J.a. PATL) A. J. 12/6/71.
