They found that Alphonoe was not present when dispute which drose between Andrea, the original owner, and the respo: ent, and that Edward with Anatori fixed the subsequent boundary. I think the decision of the District Court is sound., It is not in dispute hat there was this arbitration which must have fixed the boundary fihally. It may well be there was a prior boundary when Andrea occupied the land before the appellant came into possession, but this boundary app ars to have been set aside and a new boundary was fixed as arbitrated. It appears that nobody challenged the decision of the arbitration and therefore that decision stands. The learned magistrate did cause the "milamula" to be planted after his decision, and the appellant is complaining against this. I see no justification 1 for this complaint bccause the plants were planted along the arbitrated boundary. I am sati fied that he had sufficient reasons for reversing the decision of the }rimary Court which, in my view, misconstrued the fac.t nd failed to directits mind on the issues of arbitrated boundary. It appears that the app1lant found the respondent already in that area since it is said that he bought the disputed piece of land from Andrea Kawamara, who was not called to give evidence. The appellant also complained that the ppellat magistrate did not take the evidence of Alphonce and Andrea Kawamara when he vis ted the scene; nor did he enquire from the villagers whohad gathered on the day he visited the disputed shamba. As far the former part, he already had the evidence of Aiphonce which he carefully considered, but there was no application made by the appellant to call AnLeA Kawamara, who apparently, coild not give evidence during the trial because he could not be traced, to give further evidence subsequoutly. As for the later part, the appellate magistrate was not upposed to make random enquiries from observers as this would not be a proper procedure. In the result, I find the decision of the District Court is fully justified. Order:- Aippeal dismissed with costs fixed at shs. 150/-. / 0. ? MWANZAO (Z.N. El-Kindy) 11.1.71 AG. JUDGE..
