In agrocmint with the Whayn court of appeal the ijistrict Commissioner obsorvea, ap)arently in passing, that the appllant 's father could not pro erly revive a case which hoh been determined many years previously ;:e,aring the elleged undevsl;ped land, The trial magistrte seems to have made himself clear to the assessors that it is the respondent wo was entitlee to the land before askin: them to dive their views. Such prucedare is to be discouraged if only to ensure that a magistrate cOCS not unauly influence the minds of theassesors sitting with him, and I think in this case it is not insignificant that neither abseosor walressed his mind specifically on the jssue they.seein to hav irese opinions only as regarcisthe amount of ecrnpensation to e pia to the appellant fo improvements to the lana. The magistrate should be asic:ed to sos that he ds not give his own decision in any case :JSfOlC him until he has heard decisions of the assessors sittin, with him. In finding Yfor the respondent the trial court ssms to hav, relied heavily, if not exclusively., on the District Commissioner's judgment in civil appc-el No, 80 of 1958 to which reference has been macho above and from which the court considered that th. matter then before it was resju.icata. As aptly pointed cut by the District lvla 0 istrate in his decisjon in District Court Civil Appeal No. 171/641 which judgment is crucial to the present appeal as dill be shown a little later, the appeal nealt with by the District Commissioner was in respect of a piece of lana with stones. It is true, as already pointed out senior, that the commissioner uphold the view of the Buhays court of Appeal that, if there had been a disput between the parties over an unJeyelop.oi piuc of land (rnbuga) and if such dispute hod been finally •doLrained in juJicial proceedings then the irsstia was closed as btwcen the parties and s regards that particular piece of lana, This was unooubtocLly correct. However, as r have already sais, that was staed only obiter for neither in the c urts 'below nor in the a:aeol before the commissioner was ownership of any land described as ever in dispute between the partis ; th matter before the courts was in regrd to a stony piece of land and the decision of the courts in that cse centred on that issue. I am clear, therefore, that the finding of the trial oour.t in this ose which was norsed by the first apellat Qourt, was wrong t1a:t the matter has been adjunicated upon and finally determin.ai by the commissioner's decision. And now to Biueooa Distxict Court Civil appeal No, 171 of 1964. This was an a r peai from Buhendangabo Primary Court whtch aismisseci the responaent's mother's clai a.inst the appellats father for a piece of land which is £aaisputabl the sme land as is the subject of th. present appeal. The appellant submits in his memorandum ans stated at thhe'a. in0 of this appeal that the present case was ras judicata in view of District Civil Appeal ho. 171/64. Pliers is a lot of merit in 'this. In reference to this case the trial court had this to Sayi "The rc-sponent has also prosuced a copy of' judgment whereby late kamugisha was involved in a suit with Bi Johann iharia Balyogashaki in respect of boundary siuspates and the deceased won. The clai0e originally filed by Kumu isha was not for the cpa-n land but for boundaries and Bianamaxia did not own land over there." Bi-Johana 1/lana is the respondent's mother. In effect, the court w., saying that the disputed land hat. not been the subject of the decision in District Ccurt Civil nppoal No. 171/64, It is impoasible to say why the court considered th dieuta had ben over boundaries a-na not land for it is so cle r in thot judgment t,at-the' Suit wan in reep.c of a :ic of land which was originally owned by the lite :•dnono, It is not deer either how th court- eachea the conclaion that Jei Johann siaria sia not -awn 1nd there.
