In his evidence before the primary court he stated cateorically that he did not owra shre in tue suit land and at the hearing of the first appeal he produced before the District Court a will (exhibit A) which purports to show that Clezensia bequothed the suit land to Eustace, immanuel and Justinian. Thus it seems that the question whether or not there was a will whereby Bernardo bequethed the suit land to Clezensia who in turn bequethed the land. to Eustace, bmmanuel and Justinian was of little or no relevance in as much as the appellant claims no interest in the suit land under the will of either Bernardo or Clezensia. • It is undisputed that the respondent Daniel is a full brother of the deceased Bernardo wheroasthc appellant's relationship with Bernardo is not so close. It is equally clear from the evidence that the suit land is clan land. Thus as between he appellant ebastian and the respondent Daniel, the latter is the person who under customary law is entitled to inhexit Bernardo's land, It therefore follows that the appellant cannot claim Bernardo's land under customary law and, as has been shown earlier, he is not claiming the land under the will of Bernardo or under the will of Bernardos successor in title. I therefore hold that as between the appellant Sebastian and the respon- dent Daniel, Sebastian has no claim to the land, and if he is still in possession of that land he shouldvacate it at once in favour.of the respondent Daniel. Of course if iiustace, Emmanuel and Justinian have a claim to the land under the will of Clezensia, then it is open to them to file the claim and prove the said will and establish further that the said Clezensia had a title to the land which she could have passed to them under her will I would therefore uphold the judgement of the District Court and dismiss the appeal with costs, 1' I lvi V!ANZA R. .
