In hispètiion fo..ajpea1,he contended that the evidence was unreliable and ,thcrcforetho trial court erred in accepting such evidence. That,ti.o absence of,the money on his person and the non production of the lloj1 knife riised considerable doubt, as it was most unlikely that the rioney would not have been found on him and the knife produced in court bc that been the true versionof the incident. The money., shs.250/=, was not found on the appellant.- The're was considrabledoubt as to whether the complainant had or had not mentioned te taking of the. llcd shs.25O/r to J.m' Bakora or the Police Officer (W3), but this was not material because, in his defnce, the appellant conceded that the complainant had, all long, been alleging that he had robbed him of the money... It may be that the appellant did not then state specifically mention the figure of sl , 25O/ • although .h:..complainan id,d, that he did SO.: ., However, this ws nOt an impotant discrepancy since the chargend th evidence also disclosed that the handbag and its contents were robbed.• It was not essential that the appellait should bc found in possession of money:or the other items becase the evidence showed that his part consited of applying violence 'hTlc his colleague took away the goods.. In law he was equally responsible since they aäted together and with obvious common intention. I would agree with the appellant that the kife wasiiot ed ted in court and there Was no explanation for its.:.no;1ci.ng produced. The omission is, however, harmless, since tl3erewa.pverwhelming evidence which showed that even when the appellant came out of the house of Baiorti still h0ld a.blood stathed.:kife... The witnesses would nothave said so hd they not seen that. I see, therefore, no valid reason for finding that the trial court erred in acccptng the rosccution ,aence. I see no merit in the appeal againt conviOtiOn. Th€. scntcrce of sen (7) years is the minimtrn provided for by, law. ORDER This appeal is tismissed in toto.
