The alibi of both appellants could not raise any reasonable doubt in the mind of the court because the said alibi related to the events, tahing place during the day time on 8th November, 1971 while the charge and the evidence allege that the offence was committed during the small hours of 8th November, 1971. I am therefore of the view that there was sufficient evidence on which the, court o,ould.have convicted the appelJits as it did and I see no reason to interfere. The sentence of 14 months' imprisonment imposed on each appellant cannot be said to be manifestly excessive especially considering the nature of the weapon used and the nature of the woid inflicted. That sentence is therefore confirmed. In the result the appeals of both appellants are dismissed in their entirety. / (Sgd) (R. H. KISANC-A) JTJDGE. Appellants absent and unrepresented. Mr. W.H. Sekule for the Republic.
