Cap. 16, Vol.1 of the laws. J U D G M E N T \1 MNZAVAS J. The appellant (and another man who was acquitted) was charged with and convicted of robbery c/ss 285 and 286 of the Penal Code and sentenced to 7 years imprisonment. He has appealed to this court against the conviction and sentence. On 15/10/71 one, Peter Andalu (PW].) was a victim of robbery and had his money —.shs. 2221= stolen. He reported to the police and investigations led to the arrest of the appellant and the other man. According to complainant's story to the police and his evidence in the lower court he was on the materie.i day drinking pombe at a pombe shop locally known as Festo's bar rthen two people came and sat with him. This was at about 5 p.m. He told the court that he shared his pombe with these two men. At about 8.30 p.in, the complainant left the pombe—shop leaving the two men behind 0 It was his testimony that as he was going home he heard someone calling him from behind asking for a cigaratte. No sooner had he replied two people caught up with him and asked him to give them some money. On replying them that he had no money these two people held and pushed him on the ground. He struggled with them but he was overpowered and one of the robbers removed from his (complainant's) pocket shs. 222/= and a key ind they ran away The complainant reported to the police on the same night and mentioned the two people he had been drinking pombe with at Festos bar as the robbers. On 16/10/71 the, complainant accompanied by Surgent major Nicholas (PW3) visited Festo's bar and he pointed, at the man who was acquitted as one of the people who robbed him of his money on the night of 15/10/71. On 18/10/71 the appellant was arrested, also at Festo's bar, after the complainant had pointed him to Surgent Nicholas. The two people were eventually charged with robbery 0 In the lower court both accuseds raised an alibiz The first accused (themman who was acquitied) said that he could not have committed the offence on 15/10/71 as he was on that day at Nduguti, in Iramba district. He brought withesses in support of his defence of alibi. The learned resident magistrate found these witnesses to be credible and came to the conclusion that the first accused was away in Irarnba district, when the complainant was robbed of his money on the night of 15/10/71', He accordingly acquitted the first accused. •0 •• • • ./2 0 4:g.•-.
