Adam in turn went and summoned some militiamen who then came into the bar. In her evidence-in-chief Chausiku said that the militia- men who came were James, the deceased, and Chin±'wembe (PW4). During cross-examination she said that another militiaman, Michael Lupiana (pW5) was also present. Chausiku wont on to say that while in the bar she heard the militiamen ask the stranger why he wanted to swindle the barmaid by ordering 'pombet without paying for it. To this the stranger replied tSina.t (i do not have). Suddenly, he i.e. the stranger, arose and briskly walked out while saying, 'Kama kuna mwanaume anifuate huko nje" (If there is a man let him follow me outside). Chausiku then saw the militiamen who were empty handed follow the man. She herself remained in the bar and when it was later closed she returned to her house. She was positive the stranger did not pay for the ?pombet which he ordered and drank. In Court Chausiku said that she could not identify the stranger. The particulars she mentioned, i.e. slender, tall and dark skinned fit those of the accused like a made to measure hat but she categorically said that she could not identify anyone. Another witness was EVA d/o JACOB (pW2), an even more elderly barmaid than Chausiku (PWl) and also employed in the same bar by Saidj Adam (pW3). She testified to the effect that on a date which I take to be the material date in this case she was not on. duty herself. She was off duty. At about 7 p.m. she nevertieless decided to go to the bar. On her arrival she found people drink ing pombe. One of them was the accused. While she was in the bar she heard the accused order a bottle of "pombe.' Chausilrn who was the barmaid on duty and to whom the accused directed the order then asked him, i.e. accused, if he were aware that that would be his fourth bottle. The accused agreed and asked for it all the same. Chausiku gave him the bottle of 'pombe." She asked for payment but the accused promised to give her. Later, the accused changed and said that he had no money. Chausiku then went and reported the matter to Saidi (pW3) wiao then suggested that they seek the assistance of militiamen. The militiamen were then called and three of them, namely James, the deceased, Chjnfwembe (PVJ4) and Michael (pW5) came. Saidi reported to them that the accused was not willing to pay ±' or the drinks which he ordered and consumed. The militiamen then went to where the accused was sitting and urged hIm to pay but he did not reply. Eventually he got up and pushed the militiamen aside. Therafter he walked out. While there he said, "1 have got out. Whoever is a man should follow me." Eva saw the militiamen go out but she did not know which direction they followed. Later she returned to her house. Both Chausiku and Eva said that later they only heard that a person had been killed. Saidi Adam (pW3) too gave evidence on what he said transpired in his bar. His evidence to the extent that a report was made to him by Chausjku that accused was refusig to pay for four bottles of 'pombe' ordered and drank by him and that thereafter he went to Summon militiamen who came is similar to that already given by Chausiku and Eva on this aspect of the matter. However, according to him only two militiamen, the deceased and Chinfwembe, turned up. Michael (PW5) came later and only followed his colleagues outside and long after they had followed the accused. Thinking that accused had escaped and ran away he decided to go to the other bar in the village as it was not closing hour yet. On the way he found the militiamen and the aocused. It was dark but he still managed.to identify the persons. He noticed that the deceased was lying down. As he approached he saw the accused stab Chinfwembe several times. On seeingthis he tried to intervene and pleaded with accused to stop stabbing others. The accused then turned to him and stabbedhim on the outer side of his left small finger. Evidence was also given by one OMLLRI s/o SEKYETI (2W6) who described himself as uncle of the accused since the accused's mother is his sister. This witness testified that sometime in 1976 the accused visited his brother-in-law, one Bakari Hassani at Gomba Village. The said Bakari Hasa.ni who did not testify in this case was unwell. Later the accused came to his, i.e. Oman's house, which was then away in his shamba to visit him. In the course of their chat the accused asked him to look up some employment for him. Since, he, Oman, did not have a house in the vi34age at Gomba yet he engaged the accused to erect one for him and he agreed to pay him Sh. 1701= for the job. The accused began to errect the said house. Meanwhile, accused would on some days spend the night in the village at the house of his brother-in-law or, on other nights he would go and spend the night with 0mari in the shamba. One day Omari descended to the village to check on the progress of the house. He met the accused who then asked for some mney because, he, i.e. accused, said that he may per chance find someone to take the same home to his family. Omari gave accused Sh. 30/ and later retreated to his house at the shamba. When night fell he had his meal and retired to bed, convinced that that would be one of the nights the accused opted to stay with his brother-in-law. He was mis- taken. At about 11 p,,m. or 12 midnight he was awakened by a person who said "Hodi at his door. He got up and asked who it was The reply was, "It is I, Juma." Omari asked why he chose to turn up at that late hour. The accused pleaded with him to open the door for him. This Omari did and he got out himself instead. There was moonlight on that night. mit he saw that accused was stained with blood. He, accused was also bleeding from his forehead. On seeing this Omari asked him, "Why this blood" to which the accused replied, "Nilizuwiwa na watu hapo njiani nikitoka kilabuni. (I was held up by some persons on my way from the 'pombe' club). The accused went on to tell him that the said persons got hold of him andfell him to the ground. Thereafter they cut him on the forehead with a knife and, in self-defence, he also stabbed a man with a knife. They went on to tell Omari that he rmst have stabbed three to four but whatever was their number one fell down. Oman observed that the accused was then holding a knife. He knew it as his, i.e. accused's own knife. It was about a foot long. On seeing the blood and hearing the story Omari began to tremble with fear. The accused, as a parting shot then said to him,. "Uncle, I have defended myself and I am going borne." The accused then went away. On the following morning Omari descended to Gomba Village again. While there he learnt about the incident. The accused was nowhere to be seen. He was neither at his brother-in-law's house or where he was errecting Omarj's house. Suffice it to say, therefore, that ±'or the reasons given and on the evidence on record considered as a whole I am satisfied beyond doubt that the charge against the accused, JurnaShunda, has sufficiently been established.
