This ia confirmed .by. Mttsika Kigongo hims-elf* 1.arid his esco't Mankumbati Mtamwana. It iseasily observed that the appellant'sand the reondet's are diametrically opposed. All the same the obviosis, that Nanteni Shabara 'suceessfiilly enticed. Wankuru Samwel.. from her huband Musi.ka Ki,ongo. according to her, he so did, so tht she stayed with nim, s he was her rdutive. This is supported by Musika .1ongo, wrto would have necessirily known, if indeed the responcLnt married ankuru Samwel Manteni Shab.ra reiica1eç1t4at the respondent was f1'a4 to disclose the enticin, designs tdtheàppellant's father. This means that if Wakireri Isandiko was behind the appellant's father, was not put into the picture. What-furthr vindicates this argument, are tastimonies of Musika jigongo, :a-ndMakumbati s/o Mt a mwana whotestified that, a refund of bride price to JYlusika Kigbngo, was done .by Manteni Shabara. By this time, the appellant's fathr was still alive, and it defea$&xp1ana-ti.on, as to why the appellc.nts fatner was notnvolve it Ice was aJare of What wa goingon. It should mean therefore ~ &tj if the respondent paid any heds of battle atall, he so did to Iv1aneni Shabara. For if the appeilts father had receiied the same I do not see how, even on refunding Nusika Kigongo's bride price, .Manteni Shabara should come in, and why-ere the heads Of oatt1 not taken, •from the appellant's father's place? Ii conclusion, and with due respect to the -lower Corti, fQr the above xeasona, I am of the satisfied vicw, that the appellant's father never reoeived such bride price,. and as. Wankuru Somwel said, she nevcrLmarried by the respondent-s for if she e.5ily confesses having been married qonseou . tiyely by-a-chain of husbands, I - see no reason why she should omit the respondent, if he actually did - marry her.The respondent and Manteni .habará must have had a lot to hide, and their credibility, as per record left much to be denired. Even if it were straight forward to • onclude, that the- respondent did pay the said bride price, and married-her, and I have concluded he did not, he appears to have slept on his rights for a period bordering over twenty years, during which he knew, or he must have known, that she had be-enhangin, husbands, as oin smoker changes cigarettes. I think itis unfair to unburry a claim, that has for several generations, been left unraised. The suit should have beèh dismissed by the Court of first instance. In view of the above, the appeal is allowed with costs.
