They added that they were arrested for no reason at all and that on the material day, i.e. 4t-h December, 1977, they never went out of their house - which they used to share. They insisted that P.w.3 picked on them for no reason. In his sworn statement, the third accused said that at the material time, he wasa pupil at Mihayo Primary School. Ou 3rd Nuvémber, 1977, he Was arrested by the police and he and another person were jointly, charged with house-breaking andstealingi While out On bail, he fell ill and was rece- iting treatment as an out-pat nt'0ri4th December, 1977, he said, he was still ill and spent the whole day at his mother's house.
