Tungil and that he relevant lass Book was found in possession of Hu.rnbera Magoti (kW.4) a girl friend of the appellant. Sixt1y from the above account the following withdrawals had been made as evidenced by documents tendered at the tfial:- On 22/12/75 Shillings. 700/ On 29/12/75 Shillings lOOO/ On .6/1/76 It 1500/... 10/1/76 H 1000/- " 15/1/76 H lOOO/ 19/1/76 1O0O/ / 24/1/76 95OO/ The prosecution case was that James L. Tungu was a fictitios person and that the appellant used that name to steal the money deposited by the cheques' I have enumerated above. The appellant on the other hand maintains that James L. Tu.ngu existed at the material time and that he hails from Tarime, supplied 16,000/ briks to Buramba project, carried out construction work at the fish receiving station in Musoma and did Z a f.ew.other miscellaneous jobs for which he was paid. He denied having been found with copies of kayments vouchers and L.}..O.S bearing the name of J.L. Tungu and denied having operated the Tanzania Housing Bank account. He also denied having told the kolice that the Tanzania Housing Bank pass book was with his girl friendHumbera Magoti (1W.4) and asses that the said }ass Book mtist havbéen left with her by J. L.' Tungti w}Io according to her, was out to seduceher. The prosecution in it s effort to connect the ape11ant with the Pass- Book and to pxove the no xistenc& of J. Lt. Tiingu adduc'ed the f"ollowihg evidence:- :-Detective Sg't. Major Aujabist '(PW.l) cieposed having searched the hotiseof theappe1iant and found two copies-of Payment Vouchers No.114.and,77 and copies of L.F.O and Tanzania Housing receipt all of whiohhe name of 'J. L. Tungu. The search was witnessed by Fungo Shigumanda (kW.12) who con.firm'd'that these documents were in fact found in the 'house of. the appellant. PW1 told the court further that the aipel1anthinIse1f told him that''th pass Book in respect of which he heldthe receipt was with his gir~17 friend. Hwnbra Magotc. Cleophas Meira (PW.5)4 confirmed that the appellant did in fact mention his girl friend as being.thectistodian of the'kaa's Book. The Eass Book was infact found. Up to this stage the evidence strongly pointed sat. tea pp, e11ant as erBon*a4t*rding under thefl ne of .Y. He remembered h6vingapprov4.thewithd•ra4a1 of Shillings 9,500/ from the savingsbo.ok and thought he saw the appellant-who sought far the consent but was not quit'e' certain. Tungu. .Even her col1eagtie'Christopher . Magela (}w. 9) had. not seen the, person by the name, of J. L..Tungti although,,, . he once prepared a Payment voucher in respeet of that name. Finally the non—existance of J. L. Tungti was established by a series of negative' pieces of evidence.' For example J. 'L. Tu.ngu was said to• have been using P.
