Th ecomplainant's 26 cattle were stolen at night from his kraal on 25th June 1977. The theft wae reported to the police the same night. A group of policemen and three members of the Peoples Defence Forces together with villagers set out to track hoof marks of the cattle. When they reached a place called Rotia forest they found three heads of cattle abandned there by the thieves. They continued following hoof marks to Ngarongoro forest and there in the forest they found a group of six Masal with a heard of cattle which the complainant identified to be his. The Masai took to their heels when they saw the search party. In the process, one of the Masai was hit with a bullet on the leg and was arrested. That Masai is the appellant. The appellant's defence was that he had gone to Ngorongoro forest to look for a sight ±0 build a boma. Ihi1e in the forest he hearda gun shot and started running away. Ls he did so he was shot in the le€ and was arrested. . . . . 2/ IP
