Teemba clatch at the paraded thouGht, that the D.P.P. thouGht the case was for -: revision, as a n Ground to rely on, In fact the above did not arise 9 as Mr. Teernba, was ndt technically applyin: for oxtóntion of time within which to file the appeal, — this did not arise in his mind, as he was there to proeoute the appeal, as if it were Droperly before that appellate court. I think the maistrato should not hae allowed himself, to play partial advocacy which I hereby depricate. But even more contentiofls, is the above 3rd aspect 9 the 1st appellate rnistrate's proposition that under the proisions of section 16 (3)(a) of Maitrate's Courts Act Cap. 537, the 1st appellate court is owered on its own motipn toextend the time p4 cit her after it has cired befoc. The underlined piece is so by me, and does in my view demand, clarification as it appears nowhere in the subsection applied. And that is, if we are GoinG by the provisions of section 16 (3) Cap 537, we shall easily discrern, that the provisions say that the District Court martend the time for fili anc a1ei't1ier before or after such poliodhasped. I shall in the absence of anythina to the contrary, assure, that, the 1st appellate majistrate a had the latter underlined provisions in mind, -. The above clarified the question hauntin,; us, is whether, the said appellate Court, has power on its own motion to extend the time for filinG an appeal, before or after such statutory period has expired. As have heroin before made it clear, the ri'hts of appeal are a creation of statutes, and in this case the Kaaistrates Court 's Act.Cap.537. And material and applicable hero are subsections 16 (3)(a) and (b) of Cap. 537. They provide as follows- Sect, 16 (i)(a) • Save as herein after provided — (a) . In prooedis of a criminal nature., any person convicted of an offence by a Primary Court or where: any person has been acquitted by a Primary Court, the Director of Public Prosecutions.,,., • •.00•sSeOOSOCDuO •eeoeo ,.. if airieved by on order, or deciaion of the Primary Court, may appeal thorfrom to the District Court of the District for which the Primary Court is esta:lishcd. -. 5 . — / -5.-. 16(3) EVery appeal to a Ditrict Court shall beby way of pttI'On, and shall be filed I in the Disticif' Court, within thirty days after the date of. thc decision, or p'de' against. which .thQ appeal is bràught. Provided that - (a) The District mayoxtendthc time for filing an appeal,itherbeforc or after.such pei.od and .. (by. limad within the said period of thirty days, or any extent ion thereof granted by the District Court, the District Court may permit an appellant to stat(l , the, goinds of hiz appeal orally, and hál1 record the same and hear the appeal accor&in1y0 From the abovq it is clear, that the statutory provisions provided'a statwtory period within which to appeal to the: District Court in given circumstances oy:- (a) An accused person cnuictod of an offence by the Primary Court. (). The ijie&torof Public Prosecutioshrc Eh accused person 11-las been acquitted by the 'Primaxr Court, and • (c) 1ithin thirty clays after tc date of the decision, or order, asinst which the appeal . is sought, or within. such extended time, as may be granted by the District Court. Be that as as. it may the provisions of subsection 16 ..(3)• al subject to the proviso thereto i.ee 16 (3')(a)'nd (b) also above reproduced. That is the proviso provisions (a). and. (h) read together, are to the effect, that the District Court may extend time for filing an appeal, and if the application to extend the time for filing such an appeal, is made dthin thirt.y days, or such extended period as granted 1y the District court, the said District Court,, may allow the appellant to orally stat his/her grounds of appeal. It seems to me that,.whether:. or, not the District Court allows the appellant to stata hiq grounds for appeal, it is still oond.itional to the time when the application is made i.e. whether. it is made wiihin -thirty. days, or -within any exte- nzion thereof, or after the thirty days, or after such extention thereof. It should, therefore follow in my , view that, in criminal proe-ding before or originating from a. Primary CQIX-t, an aggrieved party who has not appealed within a statutoir period of thirty days, may do so, only if by way of application before the District Court he has sought and obtained. an cxtent-ioi of timO, forfihin: an appeal out of statutory time. ' • .rc • —6- From the abvo, I fail to even. oólioeptualize, how 1iie 1st appellao courb would act on itd own motoi. For if it did, it would have i t' prdmt the appell*, but also on its own create reasons for delay, and in so doin, it would abl/bü± un—pardonably demostrate itsolf as biased in favour of the appellant, and even be accused :of hvinrejude the appeal to b. ..,It is therefore my view that, the 1st appellate iaistrate seriously erred in law, in adrnitiii the appealout of time, without its boi prec.edOd by, an application forextension of time for filin an appeal ot of time. It follows on.hee1s asdoos to niht, that the so called DQP.P 's appeal, was not properly before the 1st appe11e cow"t. .TI1C 1st appellate court's order admit in' the same on its ovrn motion, is here:r set aside.
