It 'was uhiesputed that he lawfully sold. the 150 tags to the fiist accused fo va1ue. The law requires that any person who want to transport sified foodstuff must et a permit from the N.M.C. Th appellant was th4 i3ranch ivianager of the N.LI,C. He was the Corporation's repreeertative aA apanda. It was he who was empowered to issue ,pen.its. He had issued thC: one (Bth. I).1) to the first accused to enable him transport the maize he had bought. It appears the appellant was convicted and punished for oxcercising the powers the law has authorised him to e:ercise. If there was nybod.y having qualms for what the appellant did he should have lodged his complaint to N.I.C. head office or elsewhere but not to a criminal court. The appellant committed no offence knorn to law. I allow the appeal, que the appellant's conviction and set aside the fine ofShs.2,500 Al order that it be refunded to him. I now turn to the first accused. drasto 11,01 1 who has not appealed. I am of the view that had he ai;poaled his appeai vulc1 have succeeded. He bought the maize lawfully. The permit had been 1 eued and the train had not yet moved. By the tine it L.,O ed he would have lready collected his permit. Like the appellant, he' .ommitted no of cnc. haown to law.
