Munyera,Jo) date the 3rd day ~f October, 1984, I · in ., Criminal Sessions Case No. 54 of 1984 JUDGEMENT OF THE COURT MUSTAFA, J ,!.s_: The arpellant was in a fight with the deceased over a comparatively trivial matter and in theoouraeof it the appell"l.nt 11 stabbed the deceased with a knife on the ne•~ as a result of I which the deceased died. The deceased was apparently unarmedp The appellant pleaded guilty, was a young man of 23 years of age, and hac, no previous conviction. He had been in custody for about 2 years before he was convicted and sent ence<it and the t:dal judge apparently did not take this factor into consideration,. I The trial judge referred only to the use by the appellant of a knife and sentenced him to 10 years imprisonment. We do not '/ no::-mally interfere with a sentence imposed, but in this case, ,i taking into consideration the mitigating circumstances we have enumerated above, including the fact that the appellant had been in custody. for 2 years before being ~entenced, we feel that the sentence of 10 years is manifestly excessive.
