The prosecution case is t_hat on 28th August 9 1983 at Chase Village Kondoa District appellant Charles Senga, his brother P~W.1 ripinga Pima and their wives were drinking local liquor when an 8rgument arose over the allegation by appellant that P.W.1 was back biting. him ( the appellant) or saying nasty words about him. Appellant after some alteration threatened to kill somebody that day. Then the party moved to the house of appellant which he was sharing with P.W.1 his brother, and there appellant was seen consuinming some drinks. At the house of P .w. 1 and appellant, appellant started chasing P.W.1 in an attempt to carzy out his promise and through the door made of sticks. P.W.1 and his wife, the cleceased, quickly entered and used here weight to prevent the door from being opened. Appellant then made for the door in an ~~tempt to open it 9 he was seen r~nnming his body against it time after time - in all three times. The second time app611ant 1 s hea.d penetrated the door through thF 0.pe.rtures of the sticks.
