APPJLANT VERSUS ThEREPUJ3LIC. . . . . . . . . . .RESPONDENT (Appeal from the conviction of the High Court of Tanzania at Kondoa) (Bahati, ,) dated the 28th day of March, 1987 in Criminal Sessions Case No. 18 of 1985 JUIGNET OF THE COURT IaSANGAJ,A, This appeal arises from the appellant's conviction for murder contrary to section 196 of the Penal lCode and the sentence of death imposed on him by the High Court (Bahati, J.) sitting at Kondoa. The conviction was based primarily on the evidence of Joha Rashid (p.w.2). The witness tstifisd that on the day of the incident, as she was returning from the river at about 3 p.m., she found the deceased on the way. She and the deceased exchanged greetings. Then presently the appellant appeared and began to rough up the deceased. The witness asked the appellant what he was doing but the appellant hreatc-ned to strangle her if she made noise. Whereupon the witness got frightened and ran home. Sometime latar at about sunset the witness heard an alarm and on answering it, she found the deceased lying dead near the place where she had left him and the appellant. The medical evidence was that death was dueto a raptured spleen. The learned trial judge, however, found p.W.2 to be a witness with an interest of her own to serve, and as such her evidence required corroboration. In his evidence, of course, he denied being at the scene or seeing the deceased at all on the materia. day. In these circunistances we think that one cannot rule out completely the possibility of P.w.4, or some other person for that matter, being connected with the death of the deceased. For the reasons set out above, we think that it would be unsafe to uphold the conviction. In the result the appeal is allowed.
