Later the Plainti±f received, a copy of a lettzx which the Land Ofi'icor, !tana, addressed to the Diroctor of land Development, zea1aam on the subject of the disputed 1lot. S.. -5- The plaintiff told the Ct that t: at was the first time be was hearing 9 officially that t.o defendant bad been allocated the plot in dispute • it sens the plaintiff then wont and briefed his 'awyer. At the -time it was Nr Mahatane wL. 9 incidentally, also partiall: represented the plaintiff at the hearing of the case before the learned Couxsel 9 with leave of the Court, witbclxew froa the case, Mr Mabatano. 9 acting for the plaintiff, by his lottox' dated 14th July, 1 980 notified the Land Offioer, Tanga 9 that a civil action uas being instituted in the High Court at Tarira for trespass against the defendant.
