While s till on this 1 should point out that while the appl i cant has thronuhouf been represented bv Mr. R u t a b i ngwa Advocate . t lie Respondent has had a string of advocates. Dr. r . amwai , Mr Mi l a n z i . Mi. Me h o me . and now Mr. Ms emwa. p r o m p t ! no Mr. Rutabinnwa's observation "that he has bepn charm ino advocates like c l o t h e * " . which though cynical is not without mst i f i c a t i o n , and which act could have contributed to the present state of affairs. Now let us go back to the cent. ,1 , ssue , h iR matte,: the ruling of the Resident Mao i st r a t e ' s Court on t hr- preliminary obieel ions iaised by Mr Rulabinuwa. which M,|,na is the subject of these revisional prncfimlimis. The learned Resident Magistrate over-ruled the objections by finding that the chamber application filed on 5\11\q6 and dismissorl on was different from the one filed or, 26\7\97 (both chamber applications quoted a h o V P *; that Respondent in the present, application was not time barred as she had the protection of S. ? n of I he haw of limitation.. Ad.. Hie above quoted s e c t ion can't he called to t he aid of the Respondent as Hr . Msemwa. learned Counsel and the lower court, seem to suggest . This seel i on protects a person who is outside the territorial boundeiies when a cause of action arises, and has no representation but not a person who though outside the country originates p r o c e e d i r i gs and prosecutes the s a me either through advocates or persons with powers of attorney. Tn the present case the Respondent though residing outside the count r y was the one who filed t tie c a s e against the present Applicant, Not only that., she subsequently appointed people- w i t h powers of Attorney, and the various advocates she engaged is a telling factor- on this - that the said advocates at t i mes pr o v e d to be laxv does not ma k e I l ie said renresenlation illegal or non-existent Wh e n discussing this limitation of time issue. with respect, the learned Resident Maoist r a t e rumbled into irrelevant matters and misdirected himself in the end. He did n o t end I here for he added I hat the power of attorney uiven to Ihe persons wh o put per l e d lo engage the various lawyers for Respondent was not registered in Tanzania . and that "in Ihe eves of the law. therefore, there is no power of Attorney. The purported power of Attorney in law can't- be acted noon.
