The Sung1.1sungu members _SJ;'e sued in damages for the tort of unlawful interference of the plaintiff's 1i1Jerty. The plaintiff Delfina w/o Matwi is claiming damages in the sum of Shs 0 7oo?000/=; and also claims the return of he:r bed and a radio -e,assette, 1Joth of whi6h are worthy Shso33,000/~. The suit proceeded 9.x~pa.rte after thtf ,.five defendants (1st; 2nd., 3rd., 4th and 6th defendants) defaulted ·to file a Written Statement of Defence within the prescribed period. The plaintiff was allowed to prove her case e:x:-parte under Order 8 rule 14 of the Civil Procedure Code Act No.49 .of 1966.• The plaintiff adduced uncontroverted evidence to the effect 1hat on 10/8/1987 sbe was unlaw:f'ully arrested by a gi:-oup of membei·s of Sungu . Sungu army of Mu.soma· Tovmship. These members included 1st defendant and 2nd defende.nt. She was arrested allegedly for dealing in the manu.faJwe and selling of·illicit liquor of moshi. All the evidence there iras, con- fi sisted of an effiJ?ty drum and an empty beer bottlo, both of which allegodly . were smelling of ·,•.moshi liquor'. She was beaten at the t_ime of arrest as · conf'i:rmed by the p1ainti:ff 1·s daughter Juliet a/c Matwl_(P.W.2)o Tlie plai- , ntiff ·was thEln taken to the Sungu Sungu Council of Elders for trial •. It is said thnt the Sungu Sungu Council of Elders has about 28 . memb0:ra. This time, according to one of the members Jumarine s/o Hakongoro (P.Wo 1), there were over half of the members of the Council in attendance, including the 3rd., 4th. and 6th defendcnts. 'I'he 3rd defendant ~ras the C.hair:- man of the Council while the 4th and 6th defendants were the most vocal . a;ncl unoomp:romising members of the Council, and that is why perhaps they haye ~en picked up amonG tl:.e lot.
