20040628 TZCA Mwanza1

It is unsafe to sustain the conviction of the appellant on the basis of his retracted confessional statements which were not corroborated. The evidence of the co-accused, being that of an accomplice, also required corroboration, which was lacking. The trial court and the first appellate court erred in relying on uncorroborated confessions and in shifting the burden of proof to the appellant.
