RESPONDENT JUDGEM • • EL—KINDY, J.: This was a second appeal against the jt4gement which -gas entered in fayour of the respondent. The respondent, Daudi Kemanga, sued the appellant, .Esrom W. Gunza, f.r compensation in respect of • destroyed grondnuts and beans. He was awarded jwi,gement for She. 1 1 600/—, as 'compensation and SIts. 53/— as costs. The appellant unsuccessfully appealed to the'District Court. . . On appeal, the appellant was unrepresented but I asked a State Attorney to appear as amiea ouree as I felt that the iepuIlic mit be interested in the results of this ôase as the appellant was a civil servant 'and the suit aPose because of his duty. On the evidence, the trial oourt held that there-was no evidence thattlie alleged 16 'ags were imported from the Republic of 'Kenyao • It 'found that the eai. ags had be'n in the house of Nyambaga (P.W.3) since the 9th of February, 1971 after they had 'been brought there "for easy access to transprôrtation. The trial cduzt found that in f'ac't some of the 'deans came from the ahamba of the respondent an some of them iere obtained by way of purchase. Xt found that it was easy and eonven-ient for the respond- ent to load them from where he did bécthu.se the. buses did: not" stop or,agree to' stop to carry them at a point other 'than the, starting' point of the bus and this was near the border. However, when the bus drove, it at Siraz'i Police pest,..a distance of about j a milfrom the point of - loading, for the pljee'.ffioer and custom officials. The appellant, was present. The said l bags were discovered and,' by order of the appellant, were unleaded.. , It was a matter of dispute as to why the appellant caused - 4hem 'to be off 1aded. - However, the trial' court found' that they were un- -• loaded, because the appellant thought that they had. been unlawfully imported .•.from,the Repu.'blie otKenya although 'the. appellant alleged that the seeds were inf'ewted with dangerous pests. 'The respondent, who waá accompanied by - .-. S.imon'(P.W.l) and. others, did'not áppose' -the order of the appellant. The • .a.ppellant dee'tded to destroy the '16 ba'ga. He applied kerosene. and struck -- a matoh'oit 'theth,' but the seeds. did not burn. Then he took a knife and • tore open all 'the 16 Sags, and left the seeds spread on the road. The appellant said that he hoped that they would be distroyed. by moving vehicles, if left on the road, as he did, It wa8 a'lleged"that after tho:appellai fij had done so, he left the place,. The lower courts held against the appellant on both points, and held that the appellant was liable to pay compensation to the respondent as his action was ultra VI'3S his duty as a crop inspect- ix, and be was liable personally to pay for them. I agree. While there was no doubt that 16 bags of kbeans and groundnu).were destroyed, there was no evidence, led, to show that each bag was worth She. 100/—. Does it therefore, mean that no compensation should be made when, obviously, the respondent su±'ferred. loss? I would say no. The trial court was entitled to make its own reasonable assessment of the value of the damaged crops, and, in the circumstances of this case, that the assessed value of She. 100/—seàsonab1e value. I see no reason to interfere with this quan-tuni if compensation. In the circumstances, I dismiss this appeal with costs to be taxed by the D.R.
