The marriage settlement is valid and enforceable in Zanzibar as to the division of matrimonial property, but the respondent cannot own immovable property in Zanzibar unless she is a Zanzibari. She is entitled to the monetary value of her share in such property, not the property itself. Movable assets and the plot in Dar es Salaam are to be divided per the marriage settlement. The appellant's counter-claim for rental proceeds fails.
