In Civil Application No. 15 of 1998, the applicant was seeking leave to appeal to this court. A single Judge of this Court (ICisan.ga TA) struck out the application on the ground that the application was iricoiipetent. From that decision this reference has been preferred 0 At the hearing of this reference the applicant was represented by Mr. T. Kalunga, learned counsel and for the respondent Professor Fimbo, learned counsel appeared. In the first place Mr. Kalunga violently criticised the learned Single Judge for the observation in the ruling that the amended notice of motion filed by Mr. Kalunga was confused. He contended that in the notice of motion', he had complied substantially. with the format provided in Form A of the First Schedule to the Courts Rules, 1979. As such, he complained, the leanedSingleJudge's criticism that the prayers in the notice of motion were 'i'r.med in an unconventional way was not justified. Reaching to this Professor Fimbo for the respondent stated that' the learned Single Judge did not make a / 2- formal decision on the format of the iotice of motion but only gavea directive. We need not be detained for long on this. It is common knowledge that this Court, as the final court of the land has the power and authority in its deliberations of adjudication.to give directions of a general or specific nature to the High Court and other subordinate courts in order to ensure the correctness, legality and propriety of court proceedings. In this case, our learned brother, the Single Judge, Kisanga, J.A. gave directions of such a nature regarding the format of framing prayers in a notice of motion. From the provisions of rule 1+50) and FORM L of the First Schedule to the rules of the Court, it is clear to us that it is necessary requirement that the grounds of the application are stated in the notice of motion. In part, FOrm A states: ... will move the Court/a Judge of the Court for an order that .......... on the £rounds that •S0 0 04 000 • (underlying supplied) 0 From such wording, we are satisfied that in the notice of motion it should be indicated.what is sought in the order and the grounds fot it. In an attempt to indicate the grounds for the application in this matter it is apparent that it is done in such a way that it is not quite clear whether these are grounds of appeal in a memorandum of appeal or submissions in an appeal. Hence, the confused nature of the application which prompted the learned Single Judge to given direction. on the need for complying with the format of the application ma notice of motion. We see no cause for complaint against the learn?d Single Judges direction on this, Mr. Kalunga next. dealt with the merits of the application. He submitted that it was erroneous on the part of the learned trial judge Kileo, J. to use the terminology stija out when dealing with the application for leave to appeal.
