Procedural Posture

Land Appeal / First Appeal From District Land and Housing Tribunal Decision

  1. 1 Whether the District Land and Housing Tribunal had pecuniary jurisdiction
  2. 2 Whether the Applicants/Respondents proved ownership and description of the disputed land
  3. 3 Whether affidavits in lieu of oral testimony were properly handled

Ratio Decidendi

The proceedings and judgment of the District Land and Housing Tribunal were fundamentally irregular due to insufficient description of the disputed land, lack of clarity and adoption regarding affidavits in lieu of oral testimony, and failure to properly record and read assessors' opinions to the parties. These irregularities rendered the judgment a nullity, requiring the High Court to quash the proceedings and order a retrial.

Court Disposition

Appeal allowed. Proceedings and judgment of the District Land and Housing Tribunal quashed. Retrial ordered before a different Chairperson. No order as to costs.

Orders

  • Judgment, Decree and Proceedings of the DLHT in Land Application No. 196 of 2018 are quashed.
  • Case file remitted to the DLHT for Kinondoni for retrial before another Chairperson in accordance with the law.
