The trial court erred in awarding specific damages in excess of what was pleaded and proved (Tshs. 44,000,000/= instead of Tshs. 34,000,000/=) and in awarding excessive general damages without sufficient proof. The oral contract was valid and enforceable, and the evidence was properly evaluated. Failure to call an additional witness did not warrant an adverse inference as their testimony would have been repetitive.
