SHIRIMA.................................................................................. 159™DEFENDAN KASSIM ALLY KILONJI.............................................................................. 160™DEFENDAN ANIDEUS ANTHON HOSA.................................................... 161stDEFENDANT 6 ALLY RASHID SEVINGI................. 162nd DEFENDANT DEOGRATIUS ALOYCE MASSAWE......................................... 163rd DEFENDANT MWANAHAMISI HABIBU............... 164th DEFENDANT RULING 3(P July 2024 & 12th Septemberf2024 L, HEMED, J, There is a pending Land Case No. 7260 of 2024 between the herein plaintiffs and defendants on trespass to pieces of land known as Farms Nos. 1418 and 3260, located at Mapinga Bagamoyo. The defendants through the legal service of Mr. Nehemiah Nkoko, learned advocate, filed the written statement of defence disputing all the claims. In the said written statement of defence, a preliminary objection was raised in Hmine HtisttxaX:. - "...the Plaintiffs have no locus to sue in this matter." The preliminary objection was heard by way of written submissions. Mr. Nkoko acted for the 16th, 18th, 53rd, 60th, 92nd, 93rd, 94th, 95th, 96th, 104th, 108th, 110th, 112th and 113th defendants. The plaintiffs enjoyed the legal services of Ms. Glory Venance, advocate. Submitting in support of the preliminary objection, Mr. Nkoko asserted that the plaintiffs have no locus standi to sue in this matter for failure to involve the other co-administrator. The learned counsel insisted that the 1st 7 and 2nd plaintiffs were jointly appointed together with Margaret Ngiana Eli Lyatuu to administer the estate of the late Justine Aitalia Lyatuu. In his opinion, the 1st and 2nd Plaintiffs cannot be allowed to file any suit before a court of law claiming for any property falling under estate of the deceased unless the suit has been filed jointly by all co-administrators or administratrixes. Reliance was put on the decisions of this court in Philip Mlay(as Administrator of the Estate of the Late Anna Focus Mlay) vs. Stanibic Bank Tanzania Limited &Two Others, Land Case No. 201 of 2020 and that of Isack Lunyiliko Mhavile (Being the Administrator of the Estate of the Late Simon Lunyiliko Mhavile) vs. Fatuma Mwinyi & 5 others, Land Case No. 11 of 2023. He urged, the court to strike out the suit with costs. In reply thereto, the learned counsel for the plaintiffs was of the view that the preliminary objection raised by the defendants is not on point of law rather on facts as it is based on annexture to the plaint, "JS-1" in particular. She supported her position with the decision in Mukisa Biscuit Manufacturing Company Ltd vs. West End Distributors Ltd (1969) EA 696. 8 It was argued further that Margaret Ngianael Lyatuu passed away in November 2022 hence her power as administratrix ceased upon her death. The learned counsel for the plaintiffs cited section 45 of the Probate and Administration of Estates Act (supra) contending that after the death of the said co-administrator, the representation of the estate administered accrued to the surviving administrators, the 1st and 2nd plaintiffs. In regard to the 3rd Plaintiff's locus standi, she contended that the suit property claimed to belong to the 3rd Plaintiff was in the name of Margaret Ngianaeli Lyatuu as his guardian. She insisted that after having attained the age of majority, the 3rd Defendant is capable of instituting the suit in his own name. She prayed the preliminary objection to be overruled. In rejoinder submissions, the learned counsel for the defendants reiterated his submissions in chief. He stated further that section 45 of the Probate and Administration of Estates Act (supra), cannot apply in the circumstance of this case. In his view, the 1st and 2nd plaintiffs were required to go back to the probate court to revoke the appointment of the said Margret Ngiana Lyatuu alleged to have been passed away. 9 Having gone through the rival submissions, the court is now duty bound to determine the merit of the preliminary objection. In the course of reading the submissions, I could not find arguments being made by the counsel for the defendants in respect of the locus standi of the 3rd Plaintiff. This makes me believe and conclude that the problem of the defendants is on the locus standi of the 1st and 2nd Plaintiffs. It is elementary knowledge that locus standi is the right or ability the person has to bring a legal action to a court of law or to appear in court. The said definition has been echoed in plethora of cases including the case of Lujuna Shubi Ballonzi v. Registered Trustees of Chama Cha Mapinduzi [1996] TLR 203. It is a point of law rooted into jurisdiction as was held by the Court of Appeal of Tanzania in Godbless Lema v. Mussa Hamis Mkanga and 2 Others, Civil Appeal No.47 of 2012. In the instant matter, the 1st and 2nd plaintiffs have brought this suit before this court together with the 3rd Plaintiff in the capacity of administrators of the estate of the late Justin Aitalia Lyatuu. It is trite law that the person who has locus standi to bring in court any action on the property of the deceased is the administrator/adminstratrix of the estate of io such deceased person. This is pursuant to section 71 of the Probate and Administration of Estates, Cap.352 which provides thus: - "After any grant of probate or letters of administration, no person other than the person to whom the same shall have been granted shall have power to sue or prosecute any suit, or otherwise act as representative of the deceased, until such probate or letters of administration shall have been revoke or annulled. "[Emphasis added] In the instant case however, Mr. Nkoko, learned advocate is questioning the locus standi of the 1st and 2nd plaintiff to institute the suit at hand in exclusion of their co-administrator of estate. Appointment of administrator(s) is the function of the court to establish an office of administration of the deceased's estates. According to section 22(1) of the Probate and Administration of Estates k<±(suprd), the court has the power to put into the office of administration of the deceased's estate not more than four(4) persons. It provides thus: - "Probate or letters of administration shall not be granted to more than four persons in respect of the same property..." ii From the provision aforecited, the number of administrators appointed by the court, constitutes the proper coram of the office of administration in a particular estate of the deceased. In other words, in circumstances where there is more than one administrator, unless the co-administrator(s) consent(s) or participate(s), one administrator can do nothing in respect of the deceased's estate. I thus subscribe to what was held by this court in Isack Lunyiliko Mhavile (Being the Administrator of the Estate of the Late Simon Lunyiliko Mhavile) vs. Fatuma Mwinyi & 5 others, Land Case No. 11 of 2023, thus:- "Therefore, for the administrators to be property constituted and valid, for purpose of this suit, both two administrators mustjointly act or sue. That said, a suit by the Plaintiff alone in the absence of his co- administrator is defeated for he is said to have no locus standi to sue the Defendants." In the present case, the question is whether pleadings, the Plaint in particular has facts that show existence of another co-administrator who has not been made as party to this suit. In Mukisa Biscuits Manufacturing Co. Ltd vs. West End Distributors Ltd (1969) EA 696, court had the following to say in determining the point of objection law:- 12 "...a preliminary objection consists of a point of law which has been pleaded, or which arises by dear implication out ofpleadings, and which if argued as a preliminary point may dispose of the suit." [Emphasis added] The phrase 'by dear implication out ofpleadings'^ the meaning that the court needs only to look into the plaints and its annextures without any further facts or evidence to be ascertained in order to rule out if the point deserves to be sustained. In Ali Shabani and 48 others vs Tanzania National Roads Agency and the Attorney General, Civil Appeal No. 261 of 2020, the Court of Appeal of Tanzania had emphatically observed thus:- "At any rate, we hold the view that no preliminary objection will be taken from abstract without reference to some facts plain on the pleadings which must be looked at without reference examination of any other evidence." In paragraph 3 of the Plaint, it is read as follows: - "5. That the plaintiffs claim against the defendants jointly and severally is for trespass on farm Land No. 1418 with certificate of title No. 49737 measures 36.282 hectares and Farm No.3260 with fetter of Offer No. BAG/825/6/KS measures 17.47 hectares, 13 located at Mapinga Bagamoyo currently under the encroachment of the Defendants belong to the estate of the late Justine Aitalia Lyatuu currently under the administration of the 1st and 2fd plaintiffs and that Farm No. 3258 with letter of offer No. BAG/8249/4/KS measures 14.74 hectares belong to the 3td Plaintiff The plaintiffs therefore crave for Court Order against the trespasser Defendants to the effect that be evicted from the suit land and further order to demolish all buildings and structures unlawfully erected onto the suit land, payment of mesne profit and genera! damages for inconveniences caused and any other reliefs as the Court may deem fit andjust to grant. The Plaintiffs shall rely on the copy of the Judgment and Letters of the Administration of the estate of the late Justin Lyatuu herein attached and marked annexure "JS-1", Annexure 'JS-1' is the ruling in respect of Probate and Administration Cause No.01 of 2020 and grant of letters in respect of the Late of Justin Aitalia Lyatuu. According to Annexure "JS-1" the following were appointed administrators of the estate:- 1. Ester Nduge Justine Lyatuu; 14 2. Magdalena Luyanasia Lyatuu-Nzomo; and 3. Margaret Ngiana Eli Lyatuu. In the instant case, one Margaret Ngiana Eli Lyatuu has not been made a party to the instant case. In the submission of the counsel for the plaintiffs, it has been asserted that Margaret Ngiana Eli Lyatuu has passed away and sought refugee to section 45 of the Probate and Administration of Estates Act (supra) to argue that such co-administrator ceased to have power of administration upon her death. I have gone through all 12 paragraphs of the Plaint, I could not find any where being pleaded that such co-administratrix passed away. In Barclay Bank(T)Ltd vs. Jacob Muro, Civil Appeal No.357 of 2019 the Court of Appeal of Tanzania had this to say: - "It is a cardinal principle of law that the parties to the suit should always adhere to what is contained in their pleadings." In light of the above principle, the plaintiffs are bound by their own Plaint which in fact has no fact that state that the said co-administrator passed away. The fact that the court is supposed to determine the preliminary objection based on the facts pleaded in the Plaint, the court 15 cannot consider the assertion from the bar that is not concomitant to what is pleaded in the plaint. In the final analysis I find that the omission not to include the co­ administratrix, one Margaret Ngiana Eli Lyatuu as one of the plaintiffs, or to state facts for her exclusion, renders the 1st and 2nd plaintiffs having no locus standi to institute the instant suit in respect of the disputed land. This being the case, I find merit in the preliminary objection. The entire Plaint becomes defective for including persons who have no locus standi. In the upshot, I proceed to strike out the entire suit without costs on the ground of incompetence. Order accordingly. DATED at DAR ES SALAAM this 17thzSeptember,2024. L. HEM JUDGE 16
