' was largely due to the following grounds (as per the affidavitf:- ½.. That the advocate had not obtained the relevant vital information including a discharge voucher·, which information was vital in filing the Writ'l:en Statement of defence. 5. That between 11/2/1998 and 1/3/1998 the ofr'ice:r of ·the Applicant, vho was in possession of the said . . . Vital information, one Catherine Magodi, was away on official safari. 6. That on 27/2/1998 the learned advocate had intended to ask for extension of time to file the i-isD, but . . was unable to do so, as the case had a:!-rea.dy be~n ·.• a ~ for another mention on 27/03'/199_8 ----.- and that was before the advocate came to the district court from the High Coµrt where he had another matter.. 7. • That 'failure to present the w:ritten statement nf ··•defence. was riot due to the advocatet s :irtagvertance, • ·7. ~ ..... But with respect, it is strange that the above grounds have not been raised in the inst.ant application. The two affidavits, i.e. the one before the lowe:.' court and the _preserit one before this court, do not speal<:·t~e-~ame language• ··-.'-,: '•.: This raises dqµbt as whether the deponent is credibie in his two different statements. But all in all, since the proceedings in the lo~er court are ... ·1 hopelessly in a mess, coupled with the va)~-l\eness of \he ~~d~r as already shown above, I think justice will be injured if the pioceedings in the lower court are not strengthened up by cnusing a proper hearing and the parties give:nf1lll; :opportunity of being heard. The lower court has to make it clear as whether there is a cause of action against the 2nd Defendant/Respondent; and if there is none then a specific order neede to be made by ordering the removal of the 2nd defendant frdll the caseJ 'Ihus, in the light of my considered observations above,' I would allow the present appiication for revi~ion, not in the light of Mr; Nasimirets submission but on the strength of the reasons T have given.
