Procedural Posture

Land Appeal / Judgment on Appeal Against Dismissal for Being Time Barred

  1. 1 Whether the suit for recovery of land was time barred under the Law of Limitation Act
  2. 2 When did the cause of action accrue for purposes of limitation in a claim for recovery of land by an administrator of a deceased's estate

Ratio Decidendi

The period between the death of the deceased and the appointment of an administrator is not excluded in computing limitation; however, the accrual of the cause of action for recovery of land depends on when adverse possession by the respondents began. Since there was a factual dispute as to when adverse possession commenced, the trial tribunal erred in dismissing the suit as time barred without a full trial.
