In his argaent before thi. dourt. tho appellant-. submitted that the beans belonged to him and that he had harvested it from his own shamba He argued. that on the day he was cauht transporting the produca from his hone in lifonduli to Arusha his wife had just g Lyon birth and that he was transporting the beans to Jusha to Sell so -bhat he could gt money for his wife' s maintenance He a'gued that as he was not in. any way involve.d in a smuggling racket the trIal magistrate erred in ordering forfeiture of his eight bags of beans. The accused further arguc1 that he could not have sold hi produce at Monduli because at that time there was no branch of the National Milling Corporation in the district0 The forfeiture order did not appa:cöntly hàve the blessing of the Republic. The learned state attQrriey argued before this court that the faöts of the case did not call for forfeiture of accused's produce It was submitted that because the produce was from accusedrs own shacaba and that because he could not sell the produce at ijonduli a there was no branch of the National Milling Corporation inhc distiict at the material time, the accused had no alternative but to transport his beans to Lrusha for sale at the National Milling Corporation.
