20091029 TZHC Dodoma2
The appellant, being a prisoner, did all that could reasonably be expected by expressing his intention to appeal upon admission to prison. The subsequent delay was due to the prison authorities and his transfer, for which he could not be held responsible. The High Court erred by requiring the appellant to follow up and by considering the merits of the appeal at the extension of time stage. Sufficient cause for delay was shown, warranting extension of time.
